3. User Accounts and Registration

5. Subscription and Payment Terms
5.1 Service Plans
SafeNest Technologies offers various subscription plans and pricing tiers. Current pricing and plan details are available on our website or by contacting our sales team.
5.2 Free Trial
We may offer a 60-day free trial for qualifying customers. Trial terms and eligibility requirements will be specified at the time of enrollment.
5.3 Payment
- Subscription fees are charged in advance on a monthly or annual basis
- Payment is due upon receipt of invoice
- Late payment may result in service suspension
- All fees are non-refundable except as expressly stated in these Terms
5.4 Price Changes
We reserve the right to change our pricing with 30 days' written notice to existing customers.
6. Hardware and Installation
6.1 Hardware Components
Our Services may include hardware devices, sensors, and equipment ("Hardware") necessary for platform functionality.
6.2 Installation Services
SafeNest Technologies or authorized partners will provide installation services. Installation scheduling and scope will be determined by mutual agreement.
6.3 Hardware Warranty
Hardware components are warranted against defects for a period of [12 months] from installation date, subject to normal wear and usage conditions.
7. Data Privacy and Security
7.1 Data Protection
We implement industry-standard security measures to protect your data. However, no method of transmission or storage is 100% secure.
7.2 Building Data
Data collected from building systems, sensors, and resident interactions is processed in accordance with our Privacy Policy and applicable privacy laws.

Our platform may integrate with third-party services. Use of such services is subject to their respective terms and privacy policies.
8. Intellectual Property
8.1 SafeNest Property
The Services, including all software, applications, content, and technology, are owned by SafeNest Technologies and protected by copyright, trademark, and other intellectual property laws.
8.2 Customer Data
You retain ownership of data you input into our Services. By using our Services, you grant us a limited license to use such data solely to provide and improve our Services.
8.3 Feedback
Any feedback, suggestions, or ideas you provide regarding our Services may be used by SafeNest Technologies without compensation or attribution.
9. Service Level Agreement
9.1 Uptime Commitment
We strive to maintain 99.5% uptime for our cloud-based services, excluding scheduled maintenance and force majeure events.
9.2 Support
Technical support is available during standard business hours. Emergency support may be available for critical system issues.
9.3 Maintenance
We may perform scheduled maintenance with advance notice. Emergency maintenance may be performed without prior notice.
10. Limitation of Liability
10.1 Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10.2 Limitation of Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAFENEST TECHNOLOGIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
10.3 Total Liability Cap
SAFENEST TECHNOLOGIES' TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THESE TERMS SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICES IN THE 12 MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify, defend, and hold harmless SafeNest Technologies, its officers, directors, employees, and agents from any claims, damages, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Services or violation of these Terms.
12. Termination
12.1 Termination by Customer
You may terminate your subscription at any time with written notice. Termination will be effective at the end of the current billing period.
12.2 Termination by SafeNest
We may terminate or suspend your access to the Services immediately for:
- Breach of these Terms
- Non-payment of fees
- Illegal or harmful use of the Services
12.3 Effect of Termination
Upon termination, your right to use the Services will cease immediately. We may retain your data for a reasonable period to facilitate potential service restoration.
13. Force Majeure
SafeNest Technologies shall not be liable for any failure to perform due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, or government actions.
14. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario.
15. Compliance with Laws
You agree to comply with all applicable laws and regulations in your use of the Services, including but not limited to:

- Accessibility requirements
- Municipal bylaws and regulations
16. Changes to Terms

17. Severability
If any provision of these Terms is found to be unenforceable or invalid, such provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy and any additional terms referenced herein, constitute the entire agreement between you and SafeNest Technologies regarding the use of our Services.
